ShipSafe Shipping Protection — Terms of Service

These Terms govern your purchase and use of ShipSafe Shipping Protection ("ShipSafe"), an optional service offered at checkout on farmhousekitchenandbath.com. By adding ShipSafe to your order, you agree to these Terms.

1. What ShipSafe Covers

ShipSafe provides recovery for the following events occurring while your order is in transit between the carrier's first scan and the delivery scan at your shipping address:

  • Lost packages: tracking confirms shipment but no delivery scan within 21 days of the last carrier scan (parcel) or 30 days (freight LTL).
  • Stolen packages: package shows as delivered, but you did not receive it. Police report or signed affidavit may be required for orders over $500.
  • Damaged packages: items arrive broken, crushed, or otherwise unusable. Photo evidence of the packaging and the damaged item is required.

2. What ShipSafe Does Not Cover

  • Orders shipped to an address you provided incorrectly.
  • Orders refused by the recipient, returned to sender, or marked undeliverable due to access issues at the shipping address.
  • Cosmetic damage that does not affect function (minor scratches, dents, packaging wear).
  • Damage caused by improper installation, modification, or use after delivery.
  • Items left unattended in violation of signature-required delivery instructions.
  • Acts of war, civil unrest, government seizure, or events beyond the carrier's reasonable control.
  • Claims filed more than 30 days after the carrier's delivery scan or last tracking event.
  • Loss of, or damage to, items removed from a multi-piece order where the remaining pieces are received intact.

3. Coverage Cap

Maximum payout per order: $5,000 USD. If your protected order exceeds $5,000 and a covered event occurs, ShipSafe will cover up to $5,000. For higher-value coverage on individual items, contact us before shipment to arrange extended coverage.

Carrier liability applies first. If the carrier (UPS, FedEx, USPS, freight LTL) provides recovery for the same event, the ShipSafe payout is reduced by the carrier's recovery so you are made whole but not over-compensated.

4. How to File a Claim

  1. Visit farmhousekitchenandbath.com/pages/shipsafe-claim within 30 days of the relevant event (last tracking scan for loss; delivery scan for damage or theft).
  2. Provide your order number, the type of claim, the date you discovered the issue, and a description.
  3. Upload photos of the packaging and the damaged item (damage claims). For theft claims over $500, provide a police report number or signed affidavit.
  4. Our team will acknowledge receipt within 2 business days and resolve the claim within 5 business days of receiving complete information.

5. Resolution Options

Approved claims are resolved at our reasonable discretion as one of the following, in order of preference:

  • Replacement: we re-ship the same item at no cost.
  • Store credit: equal to the item's purchase price, valid for 12 months.
  • Refund: to the original payment method, for items that cannot reasonably be replaced.

6. Pricing and Refunds

ShipSafe is priced at 3% of your order subtotal (before shipping and taxes), with a minimum fee of $0.99, and the fee will not exceed $500 regardless of order size. The fee is added as a separate line on your order.

If you cancel your order before it ships, the ShipSafe fee is refunded automatically with your order refund. Once an order ships, the ShipSafe fee is non-refundable, except where required by law.

7. Subrogation

If we issue you a replacement, store credit, or refund under these Terms, you assign to Farmhouse Kitchen and Bath any rights you have to recover from carriers or third parties for the same loss, and you agree to cooperate with reasonable requests to support those recovery efforts.

8. Nature of the Service

ShipSafe is a service-level guarantee offered by Farmhouse Kitchen and Bath. It is not insurance and is not underwritten by a licensed insurer. We bear the cost of approved claims directly. Nothing in these Terms creates a contract of insurance, and ShipSafe is not subject to state insurance regulation.

9. Changes to These Terms

We may update these Terms from time to time. The version in effect at the time your order is placed governs that order.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of [STATE OF INCORPORATION]. Any dispute will be resolved through binding arbitration in [COUNTY, STATE], administered by the American Arbitration Association under its Consumer Arbitration Rules.
